Freedom of speech Essay

Freedom of speech and the liberty to uphold oneÂ’s expression has long been the subject of many debates. It has taken centuries if not years for mankind to come to a point where many can easily voice their opinions without having to ponder over the consequences. But one should always know where to draw the line. Freedom of expression also needs to have its limits. Two of the masterminds who put forth their work on liberty and freedom of speech were John Stuart Mill and Jean-Jacque Rousseau. The concepts penned by Rousseau contradict those that were constructed by Mil; while the former focused on the functioning of the society as a whole, the latter advocated the rights of the individual to his freedom. Mill basically argument in his piece ‘On LibertyÂ’ allows for Utilitarian approach. His main idea was to give society and human nature a complete independence to mature and expand in infinite ways and direction. The main idea revolved around the kind of power that can be placed upon the individual by the society, and how that power was wrong unless exercised in self-defense. In particular, minorities were often the ones being oppressed. Mill pointed out that this tyrannical behavior was being supported by the major thinkers of that day. Public opinion followed the opinion of these thinkers and hence ended up doing the same. ‘On LibertyÂ’ sought to diminish the power the society had over an individualÂ’s freedom by giving that individual the freedom of speech. It was identified through the works that most people had precedent and preference which further provoked dissent and thus pressurized people. Mill also noted that there was no way of judging people on their inte rference into another personÂ’s private affairs. MillÂ’s idea of complete and total independence from society is contradicted in RousseauÂ’s works ‘The Social Contract,Â’ according to which man was restricted by the state and society that he existed in, once he became a part of the land he gave up the right to himself; society had a right upon the individual which he agrees to when he chooses to exist within a given society. This, he believed, was done for the greater good of the entire society; thereby his main focus was the society and not the individual, unlike Mill. For Rousseau, society itself was like a collective individual and that collective entity was sovereign and not a singular entity. He  allowed for individuals having their own aims and goals, but asserted that the will of the collective paved way for the greater good. By this definition he gives the society the power to act for the greater good and confirms that authority as absolute. He even goes as far as to recommend the death penalty for anyone who goes against this norm. Their ideas give us two different facets of life. Should one speak oneÂ’s mind or work for the greater good of the society?Mill believed in supporting diversity while condemning conformity by rejecting any form of manipulation that could be applied to a personÂ’s opinion or behavior. It was the revolutionary authorÂ’s belief that liberty forms the basis of much of the social progress that takes place. Through ‘On Liberty,Â’ it is asserted that freedom of speech is important primarily because to begin with, the opinion which most find disdainful maybe the correct one. Secondly, even if one voices a direly disproportionate view, refuting it will only help strengthen the general understanding of the topic amongst the masses. It was MillÂ’s belief that by continuously voicing thoughts, ideas and questions people kept society moving and defied stagnation. ‘The Social Contract,Â’ on the other hand goes onto state that the authority the ruler has over the state is like that of the father over his child. There is literally absolute control. Through RousseauÂ’s argument we are told that the mighty are the fittest to lead and decide what is best for the entire society. The wellbeing of the society depends on it functioning as one body, mind and soul. Each individual is part of the grand scheme which is built around the orders of the sovereign i.e. the rulers of the state. Mill charted three categories of freedom and asserted that the society was to abide by all three, if it were a free society. The first was freedom of thought and opinion, the second being the right to plan oneÂ’s life and future and the third to associate with other individuals on mutual grounds. The main idea behind this was that one should be able to pursue their own whims without hurting others in the process. Rousseau also has three implications of the contract. The first one being the fact that the conditions of the contract are same for everyone which is why everyone will collectively make it easier for everyone else to follow, secondly an individual cannot stand against the authority because he has given up that  right because he is a part of the state, and lastly, there is completely equality ergo the natural freedom that people enjoy stays intact, regardless of the social contract. It was in the ‘Discourse of InequalityÂ’ that Rousseau observed of inequality that the powerful has the choice between giving the masses an equal piece of the pie or letting the masses rot while they took everything for themselves. He was not an advocate of the powerful; he merely illustrated how the meek must always follow them because they have no other choice. The problem with RousseauÂ’s approach is that it completely rejects the claim that minorities or small groups may have on the society. If the masses chose to, they can quite literally annihilate any small sects that they wish without as much as a blink of an eye. In this regard, we are forced to side with MillÂ’s argument. However, ‘On LibertyÂ’ has its own faults because it focuses too much on the individualÂ’s needs without paying much heed to the society. Mill believed that the only instance where any one person or the society itself was justified in interfering with someoneÂ’s freedom was for their own self-preservation. In this way MillÂ’s only restriction on liberty was when it ended up harming other people, for which he advocated restraint. He was against the idea that meddling in someoneÂ’s affair. Diversity was not something to be toyed with, but the right to liberty was to be treated with respect. One has to also note that much of MillÂ’s work is at times vague on the limitations that can be placed on an individual. Another weak point is his extreme emphasis on the individual and not creating a balance between the individual and the society. While the individual was required to support the society he/she lived in, that by no means gave society any right to probe into their matters. As stated in the ‘Discourse of Inequality,Â’ “The difference between good and bad men is determined by public esteemÂ… The rank of citizens ought, therefore, to be regulated, not according to their personal merit Ââ€" for this would put it in the power of the magistrate to apply the law almost arbitrarily,” this shows that he believed that individuality would only hinder the laws that had been catered to the society as a whole. If each person was to be accounted for then the whole as Rousseau saw it, would come to a halt. Both authors present two extreme ways of life. while one advocates complete and total freedom, albeit not at the expense of others, the other goes on to suggest that freedom is restricted only is what the choices someone more powerful has selected for the majority. For freedom of speech both arguments do not fit. There needs to be a balance between the two. One cannot allow complete and total freedom of speech because inadvertently, whether it was intended or not, an individual may end up harming the society he/she lives in. If everyone began to voice a million different point of views at the same time there wouldnÂ’t be diversity, there would be chaos. Similarly, if the entire society was to follow the whims of a few men and women then society will not be able to move on. New ideas would never develop; people would never gain knowledge because knowledge would itself become restricted. Someone needs to stop talking to allow for the silence that precedes anotherÂ’s idea. History shows us that without speaking oneÂ’s mind, no real revolutions would have taken place, that being said, history also shows us how massive panic can sweep nations because of the freedom of speech that was given to the people. A balance between the two is needed. Social responsibility needs to be practiced with the freedom of speech; the two should be taken as a packaged deal and not separately. In building a colonial administration, the Portuguese were a minority and their methods were foreign to the indigenous population based mostly in subsistence farm ing. The rise of the plantation system provided two main advantages to the colonists. The first was a legal recognition of their land ownership, which claimed huge tracts of the best indigenous traditional lands for their own personal ownership, building a hierarchy of wealth and power on this basis. The second advantage was in economic exploitation, as the plantations were designed as early forms of agricultural mass-production in order to enable surplus production and export. In farming many more products than needed by local consumption, the colonists could sell mass quantities of sugar and other products to traders who would sell them in other colonies and Europe. This created the flow of wealth, status, and power that fueled colonialism economically. Nevertheless, the Brazilian colonists relied on African slave labor to a much higher degree than other colonies. One reason for this is Brazil’s natural proximity to Africa which reduced costs for slave traders and could be traversed much quicker for a profit. "In the first half of the seventeenth century more than one-half of all slaves imported into the Americas were carried to Brazil. The close relationship between sugar and slavery was established early; and in the 'sugar revolution' that saw the explosion of sugar cultivation in the British and French Caribbean in the second half of the century, Brazil continued to be the leading New World importer of enslaved Africans."2 These slaves were forced to work in the heat of Brazil’s environment in hard labor under threat of death, but struggled and managed to maintain the dignity and culture of their African traditions in the new country. Slaves even inter-married with the indigenous and European populations to create a new generation of descendents that can be considered native Brazilians, and representative of the country’s historical evolution. The result of this process of colonization and slave trade was that millions of African slav es were brought to Brazil by traders for work on colonial plantations from the 16th to 19th century. Critical Reflection on current clinical knowledge and development Within this assignment I will critically reflect on my clinical knowledge to date and consider my future development needs with a focus on my final management placement and future career as a registered nurse. I have chosen two areas which I feel are relevant to my future development needs namely Quality Assurance and Multidisciplinary/Agency team working and using the Gibbs model (fig. 1)as a framework will reflect upon my own learning experiences and achievements to date and write an annotated reflection highlighting my development needs from which I will formulate a Personal Development Plan. This undertaking demonstrates my commitment to the need for continuing professional development in order to enhance my knowledge, skills values and attitude needed for effective nursing practice (proficiency 4.1) and will address deficits in my knowledge and skills and identify any shortcomings within my own or others practice and help me cope with practice related issues experienced within m y previous placements. I have chosen Gibbs reflective model as a basis for reflection as I feel it is easily understood and encourages a clear description of the situation, analysis of feelings, evaluation of the experience, conclusion and reflection upon the experience to consider a solution if the situation arose again (Brooker Nicol 2003). It has been advocated that reflective practices are a method of bridging the gap between nursing theory and practice, and as a tool to develop knowledge embedded in practice (Chong 2009). Furthermore in reflecting on the way we deliver care we can identify weaknesses, build on strengths and develop best practice (Myser et al 1995, Johns 1996). However, there are those who are sceptical of the practice and the idea of reflection in nursing is ambiguous and confused and not based on discipline related evidence based research (Gustafsson et al (2007). Some studies however, have shown a positive response from practitioners who have attributed refl ective practice to changes in their practice (Paget 2000, Cooke Matarasso (2005). In consideration of these views my approach to reflection as a means of recognizing strengths and weaknesses in my learning and practice to enable me to make positive changes to my future practice will be unbiased. Therefore my reflective account will include an open and honest description of what I have gained from the experience In conclusion, my main aim is to enhance my professional development by reflecting upon past education and clinical experience using the Nursing and Midwifery proficiencies as a benchmark. Furthermore by utilizing the reflective model I will not only identify my strengths and weaknesses but also recognize potential opportunities or threats which will enable me to prepare for my future development and alert me to any threats allowing me to overcome any difficulties I may encounter. Teekman (2000), states that throughout the literature it is well emphasized that reflective practice is an effective tool to reduce or eliminate the perceived theory-practice gap. I will therefore endeavour to utilize this exercise to transform my theoretical learning into evidence based practice. This allows me to give an account of the events that occurred, and in order to add significance to the narrative I will relay my feelings about the event directly after explanation about the incident. During the course of my placement whilst working in an acute psychiatric in-patient I was delegated some responsibility for particular patients by senior members of staff. In addition I was often allowed to facilitate both group and one-to-one sessions supervised by a trained member of staff. However, due to other demands within the ward environment staff were often unable to run the groups and one-to-one sessions with the patients could often be time limited. However, on one particular day I was approached by a patient for whose care I was given responsibility He appeared very agitated and complained that over the previous few days he had become frustrated by the lack of attention he was been receiving from nursing care staff the lack of information he was being given in respect of his care. He also complained that he had been informed that he would have regular access to therapeutic groups and this was not happening. This patient had show a keenness to participate fully in his care to facilitate a quick recovery and discharge from the ward I was aware that staff had been busy but felt uneasy at his distress and afraid to tell him that staff had been too busy therefore unable to run the groups. In addition I did not feel confident enough to explain his treatment plan. I was quite annoyed though that he had not been consulted or involved in this previously, therefore I consulted with his named nurse voicing my concerns and asked if she could alleviate his concerns. (NMC Proficiency 2.6) was achieved by my articulating my own emotional and psychological responses to situations with colleagues in a professional manner. By also being aware of my own limitations at the time I achieved (NMC proficiency 1.1). The nurse took him into a quiet room and in my presence explained the situation to him apologising for the apparent lack of attention he had received. She assured him that the therapeutic group would be commencing later that day and allowed him to vent his feelings and concerns about his care and anxieties about his illne ss. She reviewed his plan of care with him taking account of his wishes and desired outcomes. On listening to how she handled the session, I felt quite inadequate afterwards thinking I should have been able to deal with the situation as I was competent at formulating care plans. Following the session I decided to approach my mentor to ask to discuss the situation and we agreed that I would take the time to read through the Integrated Care Pathway of each patient under my care and become familiar with their use by suggested I attend and participate in multi-disciplinary meetings. By recognising this I was adhering to the code of professional conduct (NMC) 2008, to consult with a colleague when appropriate and work within the limits of my competence. Moreover, I achieved (NMC Proficiency 4.1) by demonstrating a commitment to the need for continuing professional development and personal supervision activities. In addition a multi-disciplinary meeting was arranged for the patient and his father and my mentor allowed me to co-ordinate this and provide feedback on his progress in order that I gain experience in multidisciplinary working. Prior to the meeting I scrutinized his ICP to familiarise myself with his situation and plan of care to enable me to identify his needs and achieved (NMC Proficiency 2.2) by providing relevant and current health information to the patient during the meeting. Rees et al, (2004) informs us that ICPs are tools which map out the pathway of clinical events and activities for all professionals involved in a specific patient group. The ICP helped clarify my roles and responsibilities as well as improve team working and communication. This enabled me to become more informed and also provide the patient with information on his plan of care which would be carried out throughout his journey from admission to discharge In attendance at the meeting were the Consultant Psychiatrist, Named Nurse, Pharmacist, Community Psychiatric Nurse, Occupational Therapist and myself. I provided feedback on the patients progress to the Consultant Psychiatrist and other team members, and highlighted the patients concerns about his treatment demonstrating (NMC proficiency 3.2)by working collaboratively with multi-disciplinary team members to enable the delivery of effective patient care, prior to the patient and his father attending. This provided the Consultant Psychiatrist with an overview of the patients mental health and progress to date. The patient and his father were then invited to attend the meeting the patient was given the opportunity to tell the Consultant Psychiatrist how he was feeling and discuss any issues he may have. He was also given the opportunity to talk about his prescribed medication and ask questions which were answered both by the doctor and pharmacist. The pharmacist also gave some advice a bout his present dose of prescribed medication making suggestions to the doctor about possible changes due to a complaint by the patient that he was experiencing stiffness in his legs. The patient was allowed to discuss his involvement in therapeutic groups he had attended and their benefits. The patients father was also given the opportunity to ask any questions and voice any concerns he may have. Discussion between me, the consultant and patient provided clearer picture of the situation I and felt more at ease having further clarified the process of his care would be while on the ward. I felt more confident and satisfied that the patient was now more at ease and satisfied with his present care and was able to meet (NMC proficiency 2.4) by updating the patients plan of care following the meeting. The next stage Evaluation Gibbs model making sense of the situation and asks What was good or bad. I was pleased to see a positive outcome which was due to inclusion of the patient in his plan of care and collaboration within the multidisciplinary team meeting which alleviate the patients concerns. I was not happy at my own lack of confidence to initially deal with the clients concerns and the fact that the patient had to complain before being fully involved in his care. Having this awareness of my own emotions and of weaknesses in my practice and consulting with the patients named nurse assures me that I am managing myself, my practice and that recognizing my own abilities and limitations (NMC Proficiency 1.1) and resolving this by taking action to improve in this area of practice. In conclusion, stage five of the Gibbs (1988) model, I feel the more experience I gain in the ward environment and more I learn about ICPs I can improve patients quality of care and collaborating with other members of the multidisciplinary team I will gain knowledge and confidence to enable me to take that step from being a student to becoming a confident registered nurse and deal complex situations such as described above. In the final stage of Gibbs reflective model the question is asked If the situation arose what would I do? I will continue to utilize reflective practice to improve on my knowledge and skills and develop my Personal Development Plan to highlight gaps in my knowledge. I will use my personal development plan within my final placement to address my weakness and build on my strengths whilst seeking opportunities for further development taking account of any threats. EVIDENCE BASED RATIONALE I have used the two main areas within my recent practice where I have identified both strengths and weaknesses. Although multidisciplinary working and the quality assurance tool Integrated Care Pathways are interlinked they will be discussed separately to maintain coherence and facilitate separate Personal Development Plans. I will therefore begin by discussing Integrated Care Pathways as a quality assurance measure, what I have learned to date, highlighting my development need, and why this is important to my practice. Integrated Care Pathways Evidence Based Rationale My experience of Integrated Care Pathways during my training has been limited, therefore I require to improve my knowledge and participation in undertaking and documenting a comprehensive, systematic and accurate nursing assessment of physical, psychological, social and spiritual needs of patients. It is necessary therefore require to further enhance my knowledge and the requirements of (NMC proficiency 2.3) as part of my development needs. ICPs have not been implemented within any of my placements in the community or long term ward settings. However, an Integrated Pathway for admission and discharge has been implemented within an acute ward setting where I was placed. This has been implemented to standardize practice across every psychiatric admission ward within Lanarkshire (Kent Chalmers 2006), and to facilitate better co-ordination of discharge planning and facilitate continuity of treatment in the community (NHS Lanarkshire 2007). Human Resource Management in Healthcare Anna Marie Bià ±as BUSINESS FACTORS THAT UNDERPINS HUMAN RESOURCE PLANNING IN HEALTHCARE ORGANISATION I.I BUSINESS GROWTH In order for an organisation to succeed, it needs to have a â€Å"map†, that will give direction to the business, and this is the strategic plan created by experts in human resource management. The human resource department needs to clearly understand where the organisation is headed. Familiarisation with the strategy, vision and values is essential for them to make HR strategies that can support business growth and development. Human resource managers need to work hard to show that well-thought out people can play a critical role in structuring the high performance the organisation needs to uphold a long term growth. Human resource department must have a full awareness of what is going on inside the organisation from knowing the number of staffs to the type of available skills, so they can make strategies that can fully utilise the abilities of the employees to support the growth of the business. It is significant that the organisation is flexible to change. As the business prosper, it’s important not to be too much attached to the previous strategies used and let go of the aspects of the organisation that no longer in line with its vision. I.II DECLINE Business decline is an indication that an organisation has poor performance and different areas need to be evaluated to determine what needs to be improved. When the business is not prospering the most common response of the HR department is to reduce its workforce. However, the consequences of this type of scheme can be very distressing for the employee, their families and the whole communities. While workforce reduction is sometimes inevitable, there are reasons why it should be the last resort when managing business decline. For example, after a yearly audit to a particular rest home, the results show that number of residents died because of infection and falls increased tremendously and so with cases of medication error resulting to decrease number or admissions for that year. The HR managers can used those results to devised programs like Health and Safety Seminars, Medication Competency, Infection Control Programs for the staffs instead of reducing the workforce. I.III CHANGE Flexibility and adaptability are traits that an organisation should have. The organisation should be able to adapt to the constant change that occurs in the market. The human resource management plan should contain procedures, standards, policies and processes that are not too overdone or underdone. In making this type of plan, there will be an area for revision or improvement without totally affecting the operation of the organisation. I.IV COMPETITION All organisation faces competition. Competition exists when various organisations offers identical products or services. There are two types of competition; direct and indirect competition. Direct competition occurs where organisations create similar products that appeal to the similar group of customers (Studies, n.d.). For example, in New Zealand there are hundreds of nursing homes that provide similar service to the aged population. On the other hand, indirect competition occurs when different businesses produce or sell products which although not in head to head competition still compete for the same money in the consumer’s pocket. For instance, a shop that sells contemporary CD’s may be indirectly competing with a movie house that attracts young consumers to spend their money on leisure activities. I.V IMPACT OF TECHNOLOGY In the contemporary world of business, the HR departments are facing the challenge of standardising human resource processes by means of improving HR information. One way of achieving this is by moving away from â€Å"the way we’ve always done thing’ towards an innovative and modern technology that requires a giant step into unfamiliar aspect of the organisation. Modern technology can be advantageous to the organisation. For instance, when operational costs and spending are questioned and scrutinised, integrating HR and Payroll technology can be considered due to its efficiency. In addition to that, the current war for skills, employee experience, retention and employee engagement are more challenging now that they are increasingly mobile and assigned in various locations; however this can be handled by modernising the means of communication and coordination in the organisation. I.VI LABOUR MARKET COMPETITION Labour market can be understood as the mechanism through which human labour is bought and sold as a commodity and the means by which labour demand (the number and type of available jobs) is matched with labour supply (the number and type of available workers) (Sagepub, 2005). When numerous organisations produce similar services and products they will be competing in hiring for people with the excellent and relevant qualifications. In order to achieve the objectives of the organisation the HR department is now challenge on how to hire and attract the right people with the right skills, knowledge and attributes in the appropriate positions despite of the existing competition in the labour market. In dealing with this business factor, the HR manager can opt to design and improve HRM activities to achieve the organisation’s human resource requirements by developing existing staff and retaining their services over the long-term. I.VII EMPLOYEE DEVELOPMENT There are four resources that all organisations should manage well: money, equipment/machines, information and people. The goal of the employee development is to improve the capabilities of the staffs and improve the organisation itself. Employee development programs may focus on individual staff or as a team. The HR managers can create and implement development programs based on the identified needs of the organisation so that the time and money invested is in line with the objectives of the business (Patton, 2002). HUMAN RESOURCE REQUIREMENT AND FACTORS THAT UNDERPINS HRM PLANNING IN A HEALTHCARE ORGANISATION II.I INTERNAL PERSONNEL REQUIREMENTS If there is any job vacancy in the organisation there’s an instance when managers fill the available position with current staff. Frequently, the company will permit any current employee to apply elsewhere in the company. This type of internal recruitment will be able to help the organisation retain highly-skilled employee. Moreover, it may include reassessing the best structure of the vacancy in a specific area, and/or relate to the desirability of developing, sustaining, and retaining valued and talented member. Letter of advice on how customer service in BA can be improved

I am writing to offer you some advice on how customer service in BA can be improved. Your Chief Executive, Mr Willie Walsh, suggested I write to you because he was impressed with my suggestions about monitoring and evaluating customer service. The four areas I will focus on are: 1. Improvements to quality 2. Reliability 3. Improvements to the organisation 4. Improvements to employees There are many ways in which you can improve the quality of your service in BA. Firstly I believe the introduction of extra staff training will highly benefit your company and in turn help improve your customer service. For instance all staff should be trained to deal with difficult customers; this can be very disruptive to the clientele and furthermore create a negative image for BA. If all staff is trained in this area it will mean that procedures can run smoothly and disruptive customers can be dealt with effectively. As well as this staff should be trained in helping people with special needs such as elderly, disabled, or young children. It is important that they are treated the same as regular customers and treated with due care and attention. This will attract attention to your company as people will know that your company is customer focused and has high levels of customer service for all types of people. Moreover you could introduce policies such as the introduction of new rules that will set higher expectations from your staff. This can include approaching as many customers as possible and asking them if they need any assistance in areas such as check-in. This will improve customer service levels as you can ensure that everyone is following the rules that have been set and in turn you can add more rules and regulations that will ensure that all staff is doing the same thing throughout your business. To each individual team you can set monthly targets, this will allow you to monitor the section and then create more objectives you plan for them to reach. This will benefit customers because each group of people will have objectives that they need to achieve and will be monitored throughout their progress to ensure the highest quality customer service is provided. As I suggested in a letter to your chief executive Mr Willie Walsh, the use of mystery shoppers and surveys will highly benefit your company in terms of customer service. These two methods will identify areas where there are problems and will allow you to put in the correct measures so this can be improved. For example if a mystery shopper identified that the staff were unfriendly, this will mean you can put in place training and/or aims and objectives and allow you to fix this issue. This will make your customer service more reliable because it will mean that it is aimed at certain aspects that have been pointed out as being under par. However it is also necessary for management to focus on customer service. This will help keep staff happy as they know that the management care about the service provided to customers and will in turn encourage them to adopt the same style. As well as this it can also improve levels of customer loyalty, this is because customers will feel that they are being treated very well and the staff are ensuring that the customer’s needs are met to the highest standard. This will not only boost the amount of return customers but also give BA the reputation of being customer focused. This will also attract customers that usually use other airlines increasing the popularity of your business and in turn the reputation of BA will grow. This will lead to increased sales as there will be a high volume of customers and consequently this will create increased profits. Finally I believe it is imperative that you train and develop your staff as this will allow you to gain the most from them. It will improve the levels of customer service they provide, and mean that they are more confident with their job roles. Secondly they will be motivated to work hard and self evaluate their performance. If each and every member of staff does this it will improve the whole of BA’s performance and make it become a more successful company. For instance if a member of staff has been trained in customer service, they will be confident when communicating with the customer and providing information (such as ticket information, baggage information), when they are positively rewarded by the customer (through language and expression) they will feel motivated to work even harder and will become critical of their own work and make sure it is to the best quality, and if not then try to improve it. This will mean that staff will constantly try to achieve the best that they can and provide excellent service. In comparison, a member of staff who has not been trained in customer service will be unsure about the way they should talk to the customer and will therefore feel unconfident with the work they are being asked to do. This will lead to them not being motivated to work hard which will make the quality of their work even worse. All in all this will mean that BA is being represented badly through its staff.

Policing Policies Today Essay

Sir Robert Peel is well known for his great contribution to modern policing. His original work as noted by Nicola and others in ‘Community policing’ began in 1829 under the Metropolitan Police Act authority. (Sutton N, Draper G and Jones J, 2005). He established the police force and worked hard to sell the professional police to the public. In other words he aimed at creating a good relationship between the police and the public. He aimed at ensuring that the public understood that the police could actually work for their best interest. According to Nicola and others, Peel coined several principles to act as a marketing strategy that would convince the public of the police legitimacy. The police were to be guided by the principles as a code of conduct. According to Clyde in ‘Criminal Justice Administration’ Sir Robert Peel was the creator of the first professional police department in the world precisely, the London’s Scotland Yard. (Cronkhite C, 2008). This paper will focus on Sir Robert and his contribution on policing to the diverse needs of the present day population. To Peel, the police would not only enforce the law through the apprehension of criminals but it would also aim at preventing crime. The cornerstone of his principles was the prevention of crime, acquisition of public support and cooperation without jeopardizing the opinion of the masses or the public as well as the reduced use of force. As argued by Nicola and others, Peels’ principles are much in line with the modern-day policing and its application would be of much influence in meeting the diverse needs of the members of the public. The contemporary policing aims at reducing the reliance of rapid responses but rather calls for effective prevention tactics. Proactive approaches of resolving crime are advocated for as compared to reactive approaches. In the modern policing, it is also important that there is the creation of community partnership that involves the public in maintaining social order and harmony in their communities. (Sutton N, Draper G and Jones J, 2005). Â  It is very important that the police work hand in hand with the public so as to effectively maintain law and order. Clyde in ‘Criminal Justice’ argues that Peel coined the philosophy ‘the police are the people and the people are the police’ to show the need that the two parties work in collaboration. As Clyde points out, Peel identified twelve law enforcement organizational principles. (Cronkhite C, 2008). 1. The police must be stable, efficient and well organized along military lines. 2. The police must be controlled by the government 3. Prove that the police are efficient would not be by the number of arrests made but by the absence of crime. This advocated for the proactive approaches to resolving crime in the society. 4. The distribution of crime news is absolutely essential. 5. Deployment of police strength by time and area was also critical. 6. No quality is more vital to a policeman than the perfect command of temper. 7. Good appearance commands respect. 8. The securing and training of proper persons is a core issue if efficiency is to be realized. 9. Every police was to be given a number due to public security demand. This would ensure that there was increased accountability level on the part of the police. 10. The police headquarters should be centrally located and easily accessible to the people. 11. Policemen should be hired on a probationary basis. 12. Police records were necessary to the correct distribution of police strength. Peel faced much rejection from those who feared that the police force would be very powerful and consequently dangerous. Such rejection made it difficult to implement Peel’s principles but with time they proved to be a success and have been used across the globe. (Cronkhite C, 2008). In order for the police to perform their duties effectively they must depend on the public to approve their existence, their lives, actions, behavior and the ability to secure as well as maintain public respect. (Jim & James Chu, 2001). The police headquarters must be in a centralized location to make it easier for people to report crimes. This would also enhance the flow of relevant or useful information that can be used to curb crimes. The distribution of crime news would also be effective in curbing crime as it would eliminate the problems of distance or proximity when tracking criminals. It is also vital for comparison purposes as well as in analyzing trends which is an important aspect in the process of decision making. A harmonious relationship between the police and the public would be a plus in as far as the effectiveness of proactive approaches to crime is concerned given the fact that the public would be more willing to report suspicious incidences. Less strained relationship between the two would be an effective preventive measure. (Edwards C, 2005). Timeliness is also very important and the police must be deployed at the right place and time if a positive effect is to be felt. It is also very important that police control their tempers or anger as this would ensure that they have a good face in the eyes of the public. People who are to join the police force must be selected properly so that after training they are able to perform and meet the ever-changing needs of the public in an efficient manner. Peel advocated for the involvement of the members of the society in the maintenance of law and order which is also called ‘community policing’. (Levinson D, 2002). Record keeping is also important for analysis purposes. All in all, Sir Robert principles are still applicable in today’s world.

Macbeth †Closing Address to the Jury, Prosecution. Essay

Good morrow esteemed lords and ladies of the court, it is within my regrets to tell you that our â€Å"noble† thane (of both Glamis and Cawdor) and King Macbeth has murdered our fair (late) King Duncan for his own traitorous and greedy purposes. Macbeth has betrayed his country and committed regicide, the highest form of sacrilege. The prosecution has found Macbeth guilty beyond a reasonable doubt, with several accounts of murder, manslaughter, attempted murder, one account of regicide and conspiring to murder. (accessory to murder) 😛 Macbeth is a murderous heathen, whom sought to heighten himself to the rank of King by betraying the country (already stated this), his King and god. An earlier witness; one of Macbeth’s â€Å"Loyal† servants, (the gentle woman) stated that he had heard Macbeth whispering â€Å"I go, and it is done. The bell invites me. Hear it not, Duncan, for it is a knell that summons thee to heaven or to hell.† Obviously scared of Macbeth’s murderous mind, the servant stayed quiet until now. There were more witnesses as of yesterday, as a cutthroat hired by Macbeth told the jury of the atrocities he had performed, before being dragged off to be executed. To quote; the murderer said â€Å"Macbeth threatened me with a certain death if I were to betray him. That was just a shimmer of the murderer within him.† The prosecution would also like to point out that straight after Duncan’s body was found, Macbeth killed the two intoxicated guards, blaming these poor innocent men for the murder, and also dispatching of two possible witnesses. Macbeth did also state â€Å"O, yet I do repent me of my fury, that I did kill them.† In stating â€Å"them†, Macbeth could have been referring to both the murdered slaves and our fair King Duncan. Macbeth also insinuated that the drunken guards murdered Duncan in his sleep, but if you look and think, and I am sure you are all intelligent Lords and Ladies, a drunken guard cannot harm more than a fly (people who are drunk are more likely to become very aggressive), as they would not be able to stand. In an earlier testimony, we called upon Lady Macbeth, who, when confronted with the evidence and questioning, cracked under pressure and confessed her hand in murdering Duncan. Lady Macbeth acknowledged Macbeth and herself plotting to murder Duncan, Banquo, and MacDuff’s wife and children. Macbeth also attempted to murder Fleance and MacDuff. A servant came forth and stated that Lady Macbeth had whispered to Macbeth â€Å"Infirm of purpose! Give me the daggers. The sleeping and the dead, are but as pictures. ‘Tis the eye of childhood, that fears a painted devil. If he do bleed, I’ll gild the faces of the grooms withal, For it must seem their guilt.† Lady Macbeth obviously did not know she was whispering loud enough for the Servant to hear. Unfortunately, Lady Macbeth has passed away now, taking her life before more answers arose. The defence earlier tried to state Macbeth was acting under the influence of three evil witches. They stated that the witches had told him â€Å"All hail, Macbeth, that shalt be king hereafter!† According to the defence, this justifies treason, heresy, murder and plotting against the crown. The court was lucky (luck is not a part of their nature) enough to get one of the Witches (Weird Sisters and they don’t listen to petty human demands and/or requests) in the room, whom stated that â€Å"Macbeth sought to murder King Duncan on his own accord; we witches merely stated he would be King.† The Witch denied fuelling Macbeth’s murderous tendencies. MacDuff, slayer of the late Macbeth, retold the account of his family’s murder, which was issued by Macbeth. He stated to the court that his wife and son were in the midst of talking when a murderer ( he wasn’t there when they were murdered he had heard news of it but never witnessed it ), sent by Macbeth shook the residence by declaring that he was a traitor. He stated that his son, a brave young lad, meant to protect his father’s name. His honourable son screeched at the Murderer, â€Å"Thou liest, thou shag-eared villain!† This was followed by a fatal stab to his son, in which Lady MacDuff ran, shouting murder. The villainous murderer sought after Lady MacDuff, who could not outrun the murderous lunatic. MacDuff was severely shaken during this testimony, for reasons obvious to the court. He also recounted the end of Macbeth, in affirming â€Å"I held his head†¦ I held the head  of the treacherous king. I had to do it; he slaughtered my family, my life! I regret to say I enjoyed it, enjoyed taking back what he took from me.† If this does not prove the guilt of Macbeth, I do not know what does. As the court can see, the mind inside of Macbeth was a sickening one, as he ordered the slaughter of innocent people, to secure his position as King. In all these dishonourable acts, I believe it is in the interest of the court to say that Macbeth is guilty of multiple accounts of treason, murder, attempted murder, manslaughter, regicide and heresy. I thank you, esteemed lords and ladies, for your time in this period of turmoil. May King Duncan rest in peace, and the wicked Macbeth burn for his crimes.

Buddhism is gaining popularity and acceptance with the American public. This could be credited to the immigrants to the USA wherein some of them brought with them their culture and religion and influenced the Americans to follow them. According to Lama Surya Das, there are many factors that influenced the acceptance of Buddhism in the western countries and this acceptance lead to a unique American Buddhism. His article â€Å"Ten Emerging Trends of Western Dharma† details the characteristics of the American Buddhism that sets its identity and tells how and why Buddhism was accepted by the American community.According to Das, American Buddhism is unique since it is meditation-based such that understanding of life and personal growth is attained. It is made it more accessible to the masses and gender equality is promoted. Some of the ways of the traditional Buddhism are also omitted to make it simpler and other meditation practices are accepted to make it more appealing. Spiritua l development is also focused to promote good psychological and emotional welfare. Exploring beyond the doctrines of Buddhism is also promoted to allow independence and self development.Spiritual communities are also encouraged to strengthen the links with each other and to develop a sense of moral and social obligation. These premises can depict the American Buddhism as different from other forms of Buddhism. This difference could then be attributed to the fact that the Americans have a different cultural background and environment such that they accepted and did only those components of Buddhism that fits them. However, Das’ premises contain some vague ideas that are insufficient to say that there is a unique American Buddhism.Some forms of Buddhism are also meditation-based, some also observe gender equality, some are also focused on the spiritual development of a person and some are also promoting spiritual communities to inculcate a sense of moral and social obligation. Omission of a component and focusing on other components doesn’t always mean that it is already a new thing. It is still patterned from the original and the difference was just due to the attitude of the people accepting it.It’s like in the revival of a classic song into a different genre, the song could have a slightly different tune or tempo, but that doesn’t make the song a new song. It was just revived and remodeled to fit the preference of the listening public. Nevertheless, Das stressed that those are just trends he observed and the existence of a genuine American Buddhism has a long way to go. But still, if his trends would be more unambiguous, it is possible that a new form of Buddhism could really take form in America.It is important to note that the acceptance of Buddhism in America is slow. This could be attributed to the fact that America is largely a Christian country, with teachings different from that of Buddhism. However, if Das’ trends ar e accurate, such that American Buddhism is non-sectarian and is open to anyone, it is possible that the American public’s reaction could shift and accept it for the meditation and the other benefits. It is most likely to happen nowadays since American life is a very busy and stressful life.If the practices of the American Buddhism could fit in with the lifestyle of the Americans, more people could be influenced to follow its teachings and practices. It will then be a few steps closer to achieving a genuine American Buddhism. Nonetheless, if the openness of the American Buddhism to other traditions and Das’ argument about Buddhism being not a religion would be pointed out, it will appear that American Buddhism would not materialize as a different religion. This means that the American Dharma would just look like a program or routine that will fit in the lifestyle of the Americans.This is because the people who would practice the Dharma would not need to convert themselv es and retain their former religion. They would follow the Dharma just for the meditation and the enlightenment it brings. This would then make it very appealing to the American Public and make it recruit more followers since it would easily fit in their lives. To sum it all up, I can say that genuine American Buddhism still has a long away to reality. But still, the efforts those people who brought Buddhism to America will not be a waste, and they would be able to harvest the fruit of their labors.
